1. Agreement to Terms

By accessing or using API Health Check ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our service. These terms apply to all users, including visitors, free users, and paying subscribers.

2. Description of Service

API Health Check provides API and endpoint monitoring services, including:

  • Uptime monitoring for HTTP/HTTPS endpoints
  • Response time tracking and analytics
  • SSL certificate monitoring
  • Alert notifications via multiple channels
  • Public and private status pages
  • Historical uptime reports

3. Account Registration

To use certain features of the Service, you must register for an account. You agree to:

  • Provide accurate and complete information
  • Maintain the security of your account credentials
  • Promptly update any changes to your information
  • Accept responsibility for all activities under your account
  • Notify us immediately of any unauthorized access

4. Acceptable Use

You agree NOT to use the Service to:

  • Monitor endpoints you do not own or have permission to monitor
  • Perform denial-of-service attacks or stress testing
  • Circumvent rate limits or abuse the monitoring infrastructure
  • Violate any applicable laws or regulations
  • Transmit malware, viruses, or harmful code
  • Interfere with other users' use of the Service
  • Resell or redistribute the Service without authorization

5. Subscription Plans and Billing

5.1 Free Plan

The free plan is provided at no cost with limited features. We reserve the right to modify free plan limits at any time with reasonable notice.

5.2 Paid Plans

Paid subscriptions are billed in advance on a monthly or annual basis. All fees are non-refundable except as required by law or as explicitly stated in these terms.

5.3 Price Changes

We may change subscription prices with 30 days notice. Price changes will take effect at the start of your next billing cycle.

6. Service Level Agreement

For Business plan subscribers, we offer a 99.99% uptime SLA for our monitoring infrastructure. This excludes:

  • Scheduled maintenance (announced 24 hours in advance)
  • Force majeure events
  • Issues caused by third-party services
  • Customer-side configuration errors

Service credits may be issued for qualifying downtime. Contact support for SLA claims.

7. Intellectual Property

The Service and its original content, features, and functionality are owned by API Health Check and are protected by international copyright, trademark, and other intellectual property laws. You retain ownership of any data you submit to the Service.

8. Data and Privacy

Your use of the Service is also governed by our Privacy Policy. By using the Service, you consent to the collection and use of data as described in the Privacy Policy.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE. YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, API HEALTH CHECK SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU IN THE TWELVE MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify and hold harmless API Health Check and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service or violation of these Terms.

12. Termination

We may terminate or suspend your account immediately, without prior notice, for:

  • Breach of these Terms
  • Non-payment of fees
  • Fraudulent or illegal activity
  • Extended periods of inactivity

You may cancel your account at any time through your account settings. Upon termination, your data will be deleted according to our data retention policy.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of significant changes via email or through the Service. Your continued use of the Service after changes constitutes acceptance of the new Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles. Any disputes arising from these Terms shall be resolved in the courts of Delaware.
